INTERPRETATION AND DEFINITIONS

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of this Return and Refund Policy:

• Company (referred to as either "the Company", "We", "Us", or "Our" in this Agreement) refers to Kind Sniper LLC, 1350 Beverly Rd, Ste. 115-109, McLean, VA 22101.
• Items refer to the items offered for sale on the Service.
• Orders mean a request by You to purchase Items from Us.
• Service refers to the Website.
• Website refers to Kind Sniper LLC, accessible from www.kindsniper.com and www.kindsniper.shop
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

AGE RESTRICTIONS

Our Service is intended for users 21 years of age or older. 

Under the Gun Control Act (GCA), shotguns and rifles, and related ammunition may only be sold to individuals 18 years or older. Other firearms may only be sold to individuals 21 years or older. By accessing or using our Service, you certify that you are at least 21 years old and comply with these age restrictions and all applicable laws. If you are under 21, you are not permitted to use this Service. 

PRODUCT AVAILABILITY AND FULFILLMENT

When a product is marked “In Stock” or otherwise shown as available on our Website, it means that the product is available for purchase based on our inventory records or current information supplied by a manufacturer or wholesale distributor. It does not necessarily mean that the product is physically on hand at our location.

Some products are obtained from a manufacturer or wholesale distributor after an Order is placed. Depending on the manufacturer’s or distributor’s shipping rules, a firearm may need to be shipped to us first and then forwarded to the customer’s designated federal firearms licensee (FFL), rather than shipped directly from the distributor to that FFL.

Fulfillment times vary by product and distributor. Any fulfillment or delivery timeframe we provide is an estimate and is not guaranteed. Timing may be affected by distributor inventory, warehouse workload, manufacturer restrictions, carrier delays, inventory-feed updates, and required FFL processing. Although we make reasonable efforts to maintain accurate availability information, inventory may change or become unavailable before an Order is fulfilled. If we determine that we cannot obtain an ordered product, we will notify the customer, cancel the affected Order, and issue a refund to the original payment method. After a refund is initiated, the time required for the credit to appear is determined by the customer’s bank or payment provider and may take several business days.

CUSTOMER CANCELLATION REQUESTS

Orders may enter processing with a manufacturer or wholesale distributor shortly after they are placed. A request to cancel an Order is therefore not guaranteed, even if the Order has not yet shipped to the customer or the customer’s designated FFL. We may decline a cancellation request if the product has been allocated, ordered from a distributor, picked, packaged, transferred, or otherwise advanced too far in the fulfillment process for the Order to be stopped.

If cancellation remains possible after we have committed to obtaining the product, we may approve the cancellation subject to reimbursement of nonrecoverable charges, including a restocking fee of up to 25%, depending on the manufacturer’s or distributor’s policies. Once an Order has shipped, it may not be cancelled and will instead be governed by the applicable return provisions of this Policy.

To request cancellation, please email sales(at)kindsniper(dot)com as soon as possible and include the applicable Order number or other information identifying the sales transaction.

Nothing in this section limits any cancellation or refund right required by applicable law. If we cannot ship an Order within a stated or legally applicable timeframe, we will provide any delay notice, cancellation option, or full refund required by law. A restocking fee will not be charged when a full refund is required because we are unable to fulfill or timely ship the Order.

OUR ORDER CANCELLATION RIGHTS

As an FFL dealer, we reserve the right to refuse and/or cancel any order for any reason. If we cancel an order due to the customer's failure to follow our processes, a restocking fee of up to 25% may be applied.

CONDITIONS FOR RETURNS

Returns are accepted under the following conditions:

• Firearms must be inspected before form 4473 is completed. If the firearm does not meet expectations regarding fit, finish, or function, do not proceed and have the FFL return it to us within 7 days. The firearm must remain unaltered and undamaged, both functionally and cosmetically.
• Non-firearm items must be returned within 14 days. Our prior return authorization is required. Items must be returned to us in their original, unopened, and unaltered condition, including all packaging and manufacturer seals. For items with manufacturer-sealed packaging, once the seal is broken or the packaging is opened, the product is no longer considered new and will not be eligible for return, even if the item remains unused. The exception to this rule is when there has been an error on our end, such as if the product received differs from the one ordered (e.g., different MPN or UPC). Any manufacturer-related defects should be addressed directly with the manufacturer through their warranty process.
• Non-returnable items include custom or personalized items, items that deteriorate quickly, unsealed hygiene-related items, items with manufacturer-warranty issues, and inseparably mixed items after delivery. Ammunition is also non-returnable.
• Return of firearms after transfer, not due to manufacturer defects but because of customer choice, is allowed only on a case-by-case basis and requires our written approval. If approved for return, these items are subject to a restocking fee of up to 25% and must meet all return conditions stated above.
• Pre-owned firearms are sold as-is and are not returnable.

"I Changed My Mind" Returns

If you decide to return an item simply because you changed your mind, provided it is not a non-returnable item and all "Conditions for Returns" are met, we will accept the return within 14 days of purchase. A restocking fee of up to 25% may apply, depending on the respective manufacturer’s or distributor’s policy. Return shipping costs, along with the applicable restocking fee, will be withheld from your refund.

CUSTOMER BACKGROUND CHECK FAILURE

If we obtained a firearm from a wholesale distributor to fulfill a customer order, and the customer did not pass the background check, the firearm must be returned directly to us from the FFL who ran the background check, at the customer's expense, within 7 days from the date of the failed background check. Upon receipt and inspection of the firearm, we will issue a refund minus a restocking fee of up to 25%, depending on the distributor's return policy.

ADDRESSING POST-TRANSFER ISSUES

If an issue with a firearm is discovered after the transfer has been completed and the issue is due to a manufacturing defect, such concerns should be directed to the manufacturer under their warranty process. Customers are entitled to the manufacturer's warranty support for defects or issues.

RETURNING ITEMS

You are responsible for the cost and risk of returning items. Send authorized returns to:

We recommend using an insured and trackable mail service as we cannot issue refunds without actual receipt of the items or proof of return delivery.

LIABILITY DISCLAIMER

The Company operates solely as a dealer of Goods and does not manufacture or modify any of the Goods available on the Service. As such, the Company shall not be held liable for any manufacturer defects and/or flaws, including but not limited to those in design, materials, and workmanship. By using the Service and purchasing Goods, You agree to hold the Company harmless from any claims or damages arising from manufacturer defects. Any issues or concerns regarding manufacturer defects should be directed to the respective manufacturer of the Goods.

Used Firearms Disclaimer

All used firearms are sold as-is, without any guarantees or warranties, either express or implied. The Company strongly recommends that all used firearms be inspected by a qualified gunsmith prior to use. By purchasing a used firearm from us, You agree to hold the Company harmless from any claims or damages arising from the use of the firearm.

We strive to ensure that product images, descriptions, specifications, UPCs, and manufacturer information on our website are accurate. The controlling identifiers for products sold on this website are the manufacturer product number, UPC, SKU, or other product-specific identifiers displayed on the listing at the time of purchase. Kind Sniper LLC guarantees that customers will receive the product corresponding to those identifiers.

Provided that the manufacturer product number, UPC, SKU, or other product-specific identifiers match the product ordered, differences between listing images, packaging, illustrative promotional photos, or manufacturer marketing materials and the actual product received shall not be considered a fulfillment error by the retailer.
